INTRODUCTION – These Terms of Service (“Terms”) are a legal agreement between you (“you” or “your”) and Remodel Fashion BV, a company incorporated under the laws of Belgium, with its registered office at Junostraat 19 , 2600 Antwerp (Belgium), registered with the Crossroads Bank for Enterprises under number BE 0757.624.141 (hereinafter referred to as: “Dressr”, “us”, “we”, or “our”). These Terms establish the terms and conditions under which you will submit information to, rent and/or purchase clothing or accessory items (each a “Product” and collectively, “Products or Items”) and receive related Services from Dressr via our website at https://dressr.be (the “Website” or “Site”).
You agree to receive all communications from Dressr under this agreement electronically via email, you agree to keep your current email address updated at all times and agree that you will be deemed to have received any notices we send to that email address.
We reserve the right to change the Terms of this agreement in the future and any changes will apply to the trying and purchase of any Products after the date of such change. We may provide notice of any such changes by email, notice to you upon log-in, or by publishing them on the Website. The revised Terms will supersede any previous versions. If you do not agree to the projected changes in the Terms as they may occur, please arrange to terminate your subscription by notifying Dressr of your unwillingness to accept the changes to the Terms by emailing firstname.lastname@example.org and by immediately returning all outstanding Products and discontinuing your use of the Services and the Website.
ABOUT DRESSR AND OUR SERVICES – Dressr is an online rental subscription service that provides fashion Items. As a member, you have the option to purchase the Items you rented under your subscription.
DRESSR SUBSCRIPTION – All Dressr subscription plans and pricing are listed on the Website and are subject to changes from time to time. As a Dressr Member, you are able to rent 2 basic Items for the lowest subscription fee offered, 3 basic or 2 basic and 1 exclusive for the second lowest subscription fee offered and 4 basic, 2 basic and 1 exclusive or 2 exclusive Items for the highest subscription price offered. You are able to swap the rental Items you selected Items for other rental Items after having had the selected Items in your possession for at least 25 days. For each of the Items you rent from Dressr under your subscription plan, You can decide to: replace the Item, purchase the Item or keep it longer. When your new Item(s) arrive, the earliest swap date for your current Items is again after 25 days. You will be billed automatically every 30 days for your chosen subscription plan from the initial date that you signed up for Dressr. Because your account renews every 30 days, there is no limit on the amount of time you are able to keep your Items. You authorize Dressr to automatically bill any and all cards on file for the membership fee and/or any other charges Dressr deems necessary.
Following rules apply to you as a Dressr Member:
(1) Your subscription will begin on the date we confirm our receipt of your first payment, and our third party payment processor will charge your preferred payment method within 30 days of authorization. Your subscription will continue on a month-to-month basis.
(2) The applicable price for the subscription is the price at the time you submit your order (we reserve the right to change prices over time, and we do not provide price protection or refunds in the event of a price drop or promotional offering). We will automatically bill and charge you each month during the term of your subscription.
(3) We may offer a variety of membership plans, including free trials, discounted pricing for limited times or special third-party promotional plans that may have different or additional terms disclosed to you at or before sign-up. Some of these are offered by third parties, and we are not responsible for their products and services. With free trials, some credit card companies may place a temporary hold on your payment method for your first payment.
(4) We reserve the right to modify, terminate or otherwise amend any subscription membership plans, provided that you will have 14 days’ prior written notice before we do so and are entitled to a full refund of fees already paid if you would prefer to cancel your subscription rather than continue under any modified or amended terms.
(5) We may cancel your subscription for any or no reason on 30 days’ prior written notice to you. You may do the same, but if it is in the middle of your subscription term, you will not receive a refund for partial months and it may mean you forfeit any membership fee. In either case, you will of course be entitled to continue using the Services until the end of the period for which you have paid before your subscription terminates. This does not affect any right to cancel you may have as mentioned below. We may also cancel your subscription if you fail to pay amounts due, or if you are in material breach of any these Terms.
(6) Our subscription will automatically renew at the then-current prices for the same length of time as your original membership term. Our pricing and applicable taxes and fees may change over time, so the pricing from one subscription term to the next may be different. We reserve the right to change subscription pricing at any time, but if we do, we will give you written notice of such change first. If you do not agree with the new pricing, you can cancel your subscription without penalty and can continue using the Services through the end of the period for which you have paid at the previous pricing.
(7) Membership fees include insurance to cover easy repairs and removable stains, but do not cover severe damage, loss, or theft – costs of which will be charged by Dressr.
CONSUMER CANCELLATION RIGHTS FOR SUBSCRIPTIONS – You normally have the right to cancel a subscription within 14 days after the date we send you the confirmation of our acceptance of your subscription request. However, you acknowledge that we start provision of the subscription Services immediately following this confirmation (which, by registering for a subscription, you request us to do) and that if you cancel within the 14-day period then the charge you pay us (and which we will deduct from any refund otherwise due to you) will be proportionate to the number of days in the month through which the Services have been provided.
To cancel a subscription, please contact us at email@example.com and provide your name, address and Member details. Nothing in this section affects your legal rights.
PURCHASING YOUR ITEMS – Dressr Members (those users who use our Subscription Services) who wish to purchase the Items after their initial rental period of at least 25 days, receive a discount on the retail price of any Product or Item, as published on the Website. All prices on our website are inclusive of VAT and mention any additional charges that may apply. Dressr reserves the right to change the purchase price at any time before the purchase takes place. By accepting these Terms, You authorize Dressr to charge the card(s) on file for any purchase at any time. For the avoidance of doubt: Dressr will always charge at least 1 (one) monthly subscription fee and any purchase of an Item shall only become effective after this term, upon completion of which the purchase price shall be charged.
FINAL SALE – You understand that all Products are sold as is and that all Products have been worn by other members. As you have had the opportunity to try on and test your Items during at least 1 (one) monthly subscription term, any Item you purchase from Dressr, following your rental of such Item, cannot be returned.
CANCELLATION OF YOUR MEMBERSHIP – You may cancel your Dressr membership at any time by sending an e-mail to firstname.lastname@example.org or in My Account. All Dressr Products in your possession must be received by and checked for quality by Dressr before your next billing date for the pause to take effect. If your Items are not received and checked for quality by Dressr, you will automatically be billed for another month and are not entitled to a refund. Additionally, all pausing must be done before your billing date. Pauses cannot be honored for previous billing dates and refunds cannot be issued for previous billing cycles.
DELIVERY – Deliveries will be made through Dressr’s shipping partners and the method of shipping will be at Dressr’s discretion. For all deliveries, you will be provided an estimated delivery date through the Website and through email once your order is placed. You must provide Dressr with a safe and secure delivery location. Once the package’s tracking information shows it has been delivered, it is your responsibility to retrieve or track down the package. Dressr will not assume responsibility for packages that have been delivered but left unattended, or that have been tampered with after proof of delivery. We recommend being present at the time of delivery and/or providing the safest possible delivery location for your package. Dressr Members are liable for Items stolen or damaged after delivery, up to price of the Items on the Dressr Website.
We send all Products cleaned, inspected, sterilized, and ready for you to wear. Dressr is not liable for any health-related complaints with any of the Products. Note that if there is any issue with the Products, such as a defect or when something is missing, it is your responsibility to let us know no later than 24 hours of receiving your Items.
ORDER CUT OFF TIME – Our daily order cut off time (Monday through Friday, excluding public holidays) is 12PM CET. Dressr reserves the right, at its sole discretion, to change its selected shipping partners and you acknowledge and agree to be bound by the shipping terms of such shipping partner.
RETURNS – You can return all of the Dressr Items in your possession after 25 days with the pre-paid Return Label and Return Packaging that you receive with your shipment. We will only provide one pre-paid Return Packaging per shipment, so all Products you want to return must be returned together. Dressr will provide you with instructions for your return and information about your eligibility to place your next order.
You must return all Items you want to replace in the same order together with the pre-paid return bag provided to you by Dressr. The Products are considered your responsibility once the tracking for your package shows delivered and until we receive your return back from the shipping carrier. When the Product(s) are received by Dressr and checked for quality, you can select new Products through the Site. There is no maximum duration for keeping the Products, as long as the membership is active.
PAST DUE ACCOUNTS AND COLLECTIONS – Should You not pay within the term set for payment, Dressr shall be released from all obligations vis-à-vis You and may, on its own initiative, cancel all Services. Every late payment shall, after a first notice of default by email, give rise to the charging of interest on arrears at the legal rate. You will also have to pay a fixed penalty of 10%, calculated on the remaining total amount due in principal, with a maximum of 1.250,00 EUR. In the absence of proof to the contrary, the computer registers of Dressr and those of our subcontractors shall constitute proof of all transactions between You and Dressr. The fact that You are communicating the number of Your debit or credit card and are confirming your order and/or Subscription constitutes proof that You are in agreement with said order and with the present Terms. This confirmation is equivalent to your signature.
METHODS OF COMMUNICATION – You agree to any and all methods of communication from Dressr. We may chat, email, text message, or call any of the telephone numbers or email addresses you provide to us for any reason Dressr deems necessary. Should you wish to discontinue communication with Dressr, contact us at email@example.com.
RENTAL OR PURCHASE CANCELLATION – We reserve the right to limit, cancel or prohibit any rentals or sales of Products for any reason, including but not limited to availability and geographic (safety or reachability) concerns. We also reserve the right to refuse a sale of a given Product and/or Item in case the price listed on the Website was subject to an obvious and accidental material error or typo for which Dressr shall assume no liability.
CHANGES TO AND TERMINATION OF SUBSCRIPTION – Dressr reserves the right to alter or change any and all aspects of the site or subscription at any time, including the subscription fee. You may pause your account at any time during your use of the Services. To pause your account, you must send an email to firstname.lastname@example.org or go to My Account. Your return must be received and checked for quality by Dressr before your next billing date for the pause to take effect. If your return is not received and checked in time (at the latest one day after delivery), your account will automatically renew and your membership fee will be non-refundable.
Dressr reserves the right to terminate any account for any reason deemed necessary by the Company. Any violation of these Terms will result in either termination or suspension of your account. Dressr is not required to issue a refund for any accounts that are terminated or suspended.
DRESSR BILLING – Dressr is a monthly subscription service. If you have multiple cards stored in your account, Dressr reserves the right to charge each card, starting with your default payment method, for purchased Items or a monthly membership renewal. Monthly memberships are only renewed for unpaused accounts and accounts that still have not returned their package. If you have not paused your account by sending an email AND returned your Items by your monthly billing date, your subscription will renew and we will charge you for another month of service at rate of the subscription plan you initially selected. Dressr will never make duplicate charges on multiple cards. Should you experience any billing issues, please contact email@example.com directly.
LATE FEES FOR SUBSCRIPTION PAYMENTS – Dressr members who fail to update their account with a valid, working credit card are subject to a 10% late fee for all payments that are past due by 30 days or more. For example, an account that is delinquent for 60 days is liable to pay the balance owed for 2 months plus 10% of the total balance. Your credit card details can be updated by sending an email to hello@Dressr.be or in My Account.
FRAUDULENT ACTIVITY AND LINKED ACCOUNTS – Fraudulent activity is closely monitored by Dressr. If Dressr finds your account to be behaving in a fraudulent manner, we reserve the right to charge your card or any cards linked to your account to recover the cost of our lost Items, including any additional/free added bonus Items to your order, for up to 100% of the retail value.
If a user is found to have multiple accounts, Dressr reserves the right to terminate any and all of the accounts. If a user is found to have multiple subscriptions, with multiple orders placed, the user will be charged up to 100% of the retail value for any Items in the customer’s possession, at Dressr’s sole discretion. Should the Items be returned in proper condition, the customer will receive a full refund.
Dressr determines if an account is linked based on various factors and ultimately it is up to Dressr’s sole discretion to determine if two accounts are managed by the same user. We reserve the right to charge any and all cards on file to collect funds for amounts owed due to account delinquency or theft. Stolen packages or missing payments due to failure to abide by these Terms of Service will result in a charge of up to 100% of the retail value of the missing Items until the Items are safely returned.
SITE PRODUCT REVIEWS – Any Dressr Member with an account on Dressr.be is able to write a review. However, these reviews are published at the sole discretion of Dressr. Dressr reserves the right to delete or alter reviews found to contain errors, spam messages, false images, or containing content not intended to help other Dressr Members learn more about the Product being reviewed. Dressr reserves the right to delete or alter any review without notifying the original author. Reviews for Products on Dressr.be are published with the sole purpose of educating other users about the Product and its fit. Reviews shall NOT be used as a means of defaming other users, nor shall they be used as a means of advertising goods or Services other than those found on Dressr.be.
NEW MEMBER PROMO CODES – These promotional codes are only allowed for new members. Dressr reserves the right to revoke your membership and any orders without a refund if you are found using these codes more than once. Creating new or fake accounts in order to use one of these promotional codes again is in violation of our Terms, and may result in termination of your account without a refund. Dressr reserves the right to research any Dressr member on public sources of social media and Google to determine if an account is a duplicate for a single member. Should Dressr find you in violation of this policy, you will not be eligible to use either of these promotional codes again.
ADDITION ITEMS – Additional Items that are purchased as add on Items or upgraded Items, and additional Items that are received as free bonus Items, are all bound by the Terms of normal subscription Item rentals. Misplacing your Items in any way will result in the same penalties that normal order Items are subject to.
YOUR RESPONSIBILITIES – To the extent permitted by applicable law, You agree that you are responsible for any and all claims, actions, costs, damages, penalties, fines, demands, losses, liabilities and expenses (including reasonable attorneys’ fees and court costs) arising out of or in connection with (i) your breach or violation of any of these Terms or any applicable law. You agree that the obligations in this section will survive any termination of these Terms, your Member account or your access to our Services generally.
LIMITATION OF LIABILITY – None of the information provided through the Site or through Dressr is a strict guarantee. All images on the Dressr Website are used for illustrative purposes only. Please note that pictures of Items were taken in different light conditions and using the various photographic equipment. Computer screens have different individual settings that moderate colours and patterns independently. Images are indicative of the quality and style of the Item but may not represent the actual detail of the Item as received.
Due to the fact that Dressr uses third party shipping, delays or inaccuracies may occur. Dressr reserves the right to make changes to the Website and the Services at any time. The Dressr Website may be unavailable due to maintenance and you may experience site errors due to maintenance.
DISPUTES – These Terms shall be exclusively governed by Belgian law.
The European Consumer Centre Belgium(https://www.eccbelgium.be/) provides information about alternative dispute resolution which may be of interest to you. It is your choice to use it if there is a dispute regarding these Terms that cannot otherwise be resolved.
CHANGES TO OUR TERMS – We reserve the right to amend these Terms at any time without prior notice. Notice of any change will be posted on this Website. Please check this page periodically for changes. Your continued use of the Website after any changes or revisions to the Terms shall indicate your agreement with the Terms. The Terms of Service constitute the entire agreement between you and Dressr regarding the use of the Website and any provision of Services by Dressr.
